Attorneys in the Land Condemnation & Eminent Domain Practice Group at Cranfill Sumner & Hartzog LLP (CSH Law) recently won a major verdict for the owners of a commercial shopping center located in Wilmington. Due to a road widening project on Kerr Avenue and Market Street in Wilmington, Carmine LLC lost a driveway and access point on Kerr Avenue, half of a driveway and access point on Market Street, a minimum of 40 permanent parking spaces and 50 parking spaces throughout the five years of construction.
The CSH lawyers presented two expert witnesses who testified Carmine LLC was entitled to just compensation of $1,025,000 and $1,200,000. The DOT’s deposit was $263,007. The jury took less than ten minutes to award the entire amount presented by the CSH lawyers. With interest, the recovery will be nearly $1,350,000.
